EM and the Law

For years the state of Maine has had extensive debates and studies over the issue of electronic monitoring. While much of this has focused on the issue of the use of electronic monitoring in domestic violence cases, in recent years the focus has shifted to pretrial justice and the use of EM as a tool of pretrial release. The extent of debate and conflicts over jurisdiction has largely meant that electronic monitoring remains an issue that pops onto the agenda at the state and local level but prompts more conflict than agreement. Surprisingly, there have been several fundraising drives by supporters of electronic monitoring at the state level. Though they have raised thousands of dollars, they have not succeeded in getting laws through the state legislature despite this advocacy.
